“Multiple jobs” is one of the hottest H‑1B topics.
Typical combinations of the question look like this:

I already work at Google, but my H‑1B was selected through Atomeocean.
→ Will this hurt my Google job?

I don’t work at Google yet; my H‑1B was selected through Atomeocean.
→ Will that stop me from joining Google later?

I work at Google and won the H‑1B through Atomeocean.
→ Can I now move to Amazon?

…and so on.

Working two (or more) jobs is perfectly normal in the U.S.
Immigration officers, CBP agents – even parking‑lot security guards – will not “crack down” on you just because you have more than one employer. Keep calm and analyse the rules before you decide.

The key is due‑process under U.S. law: innocent until proven guilty.
Don’t convict yourself before anyone even raises a question.

2 · The Cup & Lid Analogy

Job position = Cup
H‑1B approval = Lid

USCIS issues a lid only after it sees a qualifying cup.
Each lid fits exactly one cup. The annual 85 000‑cap means many cups, few lids.

2.1 USCIS Only Asks: “Do You Have A Lid?”

Let’s see which combinations break, or do not break, that rule.

CupsLidsStatusExplanation
11Typical case — one job, one H‑1B.
10On OPT/CPT waiting for lottery.
00Still job‑hunting.
12Impossible: USCIS won’t issue a second lid for the same cup.
21Most common “multiple‑job” scenario. One employer sponsors your H‑1B; the second job is done under OPT, CPT, green‑card EAD, etc.
22Concurrent H‑1B — both employers filed and obtained separate approvals. Rare but perfectly legal.

2.2 Concurrent H‑1B (2 Cups + 2 Lids)

If both employers independently file and win an H‑1B for you, you hold two fully valid permissions.
USCIS allows this as long as schedules do not conflict.

3 · H‑1B Transfer = Moving the Lid to a New Cup

Transfer = unscrew the lid from Cup A, screw it onto Cup B.

  • You may work for the new employer as soon as the transfer petition is filed (AC21 portability).
  • Once approved, Cup B owns that lid; Cup A may be discarded.

4 · Worked Example – Switching Jobs Before 1 October

Timeline
‑ 31 Mar. Lottery selection (Atomeocean)
‑ 19 Apr. File I‑129 package
‑ 01 Jun. USCIS approval notice
‑ 19 May ☞ You want to start at Amazon before approval arrives

Step 1 Start at Amazon on OPT
Use your valid OPT EAD; Amazon on‑boards you legally.

Step 2 After 1 Jun. approval → file H‑1B Transfer to Amazon
Once transfer is filed you may keep working without interruption; when approved your status flips to H‑1B with Amazon.

5 · Key Take‑aways

  • One H‑1B approval = one employer relationship — the Lid.
  • You may hold many jobs (cups), but only one lid at a time unless you obtain a second concurrent H‑1B.
  • Transfer = move the lid; concurrent H‑1B = second lid is issued.
  • Understand this model to separate employment freedom from immigration constraints.

6 · Frequently‑Asked Questions

Does multiple employment increase RFE or denial risk?

No. Premium or normal processing, single job or multiple jobs, USCIS applies the same legal standard.

Can I upgrade to Premium Processing after receiving an RFE?

Yes. File Form I‑907 at any point while the case is pending.

If USCIS issues an RFE within 15 days of Premium Processing, is the fee refunded?

No. An RFE counts as USCIS action. After you respond, a new 15‑day clock starts.

When may I file for Premium Processing?

Any time: with the initial filing, after filing, or even while responding to an RFE.
